Mr. Brandon, 515 Hidden Creek Drive, Monroe, Ohio stated he was in support of
the ordinance to transfer 1607 Central Avenue. The Middletown Custom Cabinet
Company is a vital asset to Middletown and downtown Middletown. By transferring
these properties, it will make Middletown Cabinet Company more visible and will give
Middletown Cabinetry more space. He stated his company had done over $250,000
in business with Middletown Cabinetry and he supports that ordinance.

Mr. Mulligan stated Council is revising its agenda this evening and that ordinance
would be removed.

Ms. Gilleland stated the agenda would be amended to delete that item. A council
member has a potential conflict and Mr. Armbruster is absent, so they will not be
able to pass that legislation as an emergency without six votes. It will be brought
back at a later date.

Mr. Smith asked the reason for bringing that legislation as an emergency tonight.

Ms. Gilleland responded there are sale contracts and a transfer of property each
with time limits on them. Staff discussed having a first reading tonight with a first
reading the first meeting of April, however the Mayor will be absent at that April 6
meeting, so the only option was to bring it as an emergency tonight.

Mr. Picard suggested consideration as a first reading tonight with a second
reading at the first meeting in April, it could take effect thirty days after that.

Mr. Robinette stated the timing of the contract would expire within the 30 days.
Based on what they knew this morning, they could continue to work with the parties
to see if the issues could be worked out.

Mr. Picard suggested proceeding tonight with the 1st reading as not to delay the
transfer indefinitely.

Ms. Scott Jones stated there are questions that have to be answered. There
have been articles in the newspaper about the initial cost of the property. There are
concerns, whether they are spoken about tonight is not the issue. If the terms stay
the same, there are questions to be asked and answered.

Ms. Gilleland said she would like to discuss this in executive session and take
action at a later date.

Mr. Laubach didn’t feel it would look good to pull it from the agenda, go into
executive session, then come out of executive session and pass as an emergency.
He stated he would prefer to discuss it in public and ask questions.

Mr. Smith agreed, it does give the public the opportunity to have questions
answered. He also would like to proceed with the first reading and staff report
tonight.

Ms. Gilleland stated that staff would amend the ordinance to indicate the first
reading and proceed tonight.
