Since when do illegal immigrants have rights under our constitution?

CINCINNATI — Butler County Sheriff Richard K. Jones was in federal court Tuesday, Jan. 26 facing charges that he violated an illegal immigrants constitutional rights. The charge stem a lawsuit filed after a 2007 incident when Luis Rodriguez and others were rounded up at a construction site on Port Union Road by Butler County deputies and a former immigration specialist hired by Jones, according to reports. Officials said they were at the site to talk to a supervisor about undocumented workers, but while there Rodriguez and others were interrogated and asked to provide identification, said Rodriguez’ attorney, Al Gerhardstein, said Tuesday. Gerhardstein said his client, who had lived in Butler County for 11 years, was arrested and charged with providing a false identification and deported to Mexico, though he was later acquitted of the charge. Rodriguez’ children, including two born in the United States, returned to Mexico, too, to keep the family together. Attempts to reach Jones Tuesday were unsuccessful. The court will decide if Jones authorized deputies and the former ICE agent to arrest Rodriguez and whether he had the right to do so, according to reports. Gerhardstein contends that Jones doesn’t have that authority and that Rodriguez’ fourth and 14th amendment rights were violated. “He’s a man who was peaceful. He paid taxes 11 years ... He was trying to take care of his family. He was a nonviolent person. He lost a great deal by being rounded up with no probable cause,’’ Gerhardstein said. |

I'm not well versed in ICE laws, but if you are an I-L-L-E-G-A-L how does the Constitution apply to you? Wouldn't that be like saying the Constitution applies to an individual (non-us citizen) in any other country?
I know I had a scenario about questioning whether or not the Dayton Police should ask possible/definite illegals that were witnesses to crime about their immigration status, but this seems completely different. Does the Constitution apply to foreign dignitaries? Does an officer need a warrant to arrest/question them?

Rodriguez attorney Al Gerhardstein said that he was a "peaceful man", he paid taxes 11 years and that Rodriguez's 4th and 14th AMENDMENT RIGHTS were violated. WHAT?????? Since when does a person who is here ILLEGALLY have ANY AMENDMENT RIGHTS. HE'S NOT SUPPOSE TO BE HERE IN THE FIRST PLACE! OPTIMAL WORDING HERE COUNSELOR- YOUR CLIENT IS HERE ILLEGALLY as in HE BROKE THE LAW. Not only throw the guy out of the country but fine the company who hired him for 11 years and regulate who they hire until they can prove that they understand the laws. Gerhardstein's comment- "rounded up for NO PROBABLE CAUSE" is an insult to everyone's intelligence. IMO, this lawsuit should be thrown out of court as frivilous and this "bleeding heart" attorney needs to be taken "out back" for taking on such a case. You'll not get any sympathy for your client on the illegal issues from too many people around here, Gerhardstein.

There is something wrong or not stated in the article.
How/why was he aquitted when he had a false ID ? How was he paying taxes with false info unless he stole someones info ? In order to pay taxes you have to have a social security number. There is no mention in the article that this person became a U.S. citizen. Plus if an american citizen provides a cop with false ID that is enough reason to be arrested.
If this article came from the Journal then it's probably not accurate. There is to many open ended questions about this.

Hermes, It is from the Journal and there is a lot wrong with this story. Why does a cop not have the right to ask if someone is a legal citizen? I am baffled by this whole store.

I just watched the channel 12 news and they reported the exact same story word for word that the Journal printed. What do these people do,sit around and read newspapers and THEN report the news ? What a joke.
But yeah Randy,something has been left out and if not then Sheriff Jones may just be a _____ ?!!
