From Middletown's Weekly Update From The City Manager

I met with a relative of the Tytus’ who initially expressed interest in the cemetery vault project.  She is talking with her relatives about assistance for the vault, but first indications are that she believes that we have other projects around town that are more important.   We are going to hold off on the demo for 1 month to see if she can garner any interest.

I have a question out of historic curiosity only. Was the valut used only as an interum placement for the deceased during the winter months, until placed in garves, and that no individual is actually in the vault presently?

If that is the case, while appreciating the significance historically of the vault as an interim placement (in Pa. they used caves in the 1700-1800's), that provides some degree of balance in this issue. If it is a fact there are existing individuals buried in the vault (which I believe I have this figured correctly), then I can understand better at least, the city's position. If you can't maintain a curb which is crumbling, why spend $60,000. on a stone building not used for 200 years? Just curious what the vault has in it NOW?

The City CAN maintain the crumbing Curbs, they simply choose NOT to so as to use that Money for the projects the Middletown Elite want promoted.

As I stated before I believe the city is doing this in spite. I think Ms. Vivian stepped on toes and kicked some ankles and they are acting like children about it. I've never seen city officials act like total jerks the way these people do.
 
When the council goes in November then PAID administrators should go shortly afterward !!!

Would anyone know, and perhaps the question is to Ms. Moon, has a lawsuit been filed, and has injunctive relief been sought, to avoid the city tearing down the vault? Also, I remain perplexed; is the vault housing the dead or it was used for storage years ago? Thanks.

accuro,I think the vault is used to house tools and stuff. It doesn't have any remains inside. But it's the historical & irreplaceable value which makes it important.

    The Middletown Cemetery is the most historic 11 acres in Middletown and was established in May 30, 1827. The vault was built as an open shelter for funerals and later it was lined with brick and used as storage for bodies during the winter months.
    If the City had made minor repairs on the vault over the years we would not be having this conversation. The vault is now being used for storge. I informed the City 5 years ago that the  Middletown Cemetery was not in compliance with ORC 4767 which clearly states that they MUST take care of the cemetery and all strutures on this property. I have worked for the past 5 years to bring the cemetery up to these minimum standards of Ohio State Law without help from the City. 
    Mr Kohler told me that if I would get the Middletown Cemetery declared historic he would give me CDBG funds for the vault repair. These CDBG funds were the same monies that were used to restore Main Street and Downtown area. 
    The Middletown Cemetery Perpetual Care Fund is also missing.
    Yes I have filed against the City with the State of Ohio.

I do not think it matters if the Vault is being used now as it was in the past to hold a dead body, or if it is being used to hold the headstones that have been broken and vandalized or for a tool shed.  The point is that this is the Focal Point of this HISTORIC CEMETERY and the City owns this property but they refuse to take care of it just as they refuse to take care of other property they own in this dying city.

Vivian she says she is holding off for 1 month.  Since there a complaint filed against this situation, can they legally demolish it while it is still pending.  If so, what can be done to stop the city from doing this.

Recommendation:  Ms. Moon- you should have your attorney file an injunction, or your efforts will be moot. I read the city is planning on destroying it associated with danger and the expense. Without injunctive relief, it renders your efforts moot.
