HAMILTON— A Hamilton father charged last week with negligent homicide, after his 5-year-old son died of a self-inflicted gunshot wound, was arrested Monday night, Aug. 3.

David Nesbitt, 35, of North West Washington Boulevard, was taken into custody on the first-degree misdemeanor charge at about 6:15 p.m. and posted a $1,500 bond, according to police Sgt. Tom Kilgour, pubic affairs supervisor.

Nesbitt was arraigned in Hamilton Municipal Court this morning, Aug. 4, where a pre-trial hearing was set for 8 a.m. Aug. 18.

Nesbitt’s son, Zachariah, died July 18 at The Fort Hamilton Hospital after he accidentally shot himself at home with a 9 mm Glock handgun

I think the father should be held accountable, but why not arrest the 2 mothers who had left their daughters to die of heat exhaustion in their cars?  I recall the prosecutor saying the mothers/families had suffered enough.  This man hasn't suffered enough?
Just seems like there is a double standard around here for when men and women commit the same crimes

It's not a "double standard" thats involved. It's the fact that a GUN was involved. Had the two women you mention used guns they would have recieved the same, probably.
No more democrats no more republicans, vote Constitution Party !!

So what your saying is that two woman can leave there kids i n a car to die from the heat but because this other kid got ahold of his dads gun(which i believe was put up) that means he should go to prison?
If you  think about it the women in those cases where more at fault, they knew it was hot outside and left their kids in cars with the windows up, mind you, so they could shop.
So who is more at fault for their childs death? they should be going to jail, but to say that because a gun was involved the cases are different? kids are still dead and the man is going to jail, while the women in those cases are still out shopping.

I agree with you 100%,the women in question should have gone to jail but got off scott free. The LAW says any time a GUN is involved the rules are more stringent. Just watch the news, the criminals who use guns get a much more severe penalty than ones who don't,and the next thing your going to say is this was not criminal and thats true but a gun was used. What do you think would have happened to the father had the child used a kitchen knife ?

I do agree that the law says what it says about guns and in my opinion the law be changed for cases just like this. had been a knife he would still be in trouble i think so anyway.

Alldaywatching---A knife was used in when a child climbed up on a desk and stabbed his younger brother.  Was non-fatal, but I think was serious.  A knife was left in place for a small child to stab another.  No charges filed.

Thats my point, is that not negligent? If you are gonna charge one you should charge all.

I disagree with anyone NOT being charged with leaving a child in a car on a hot day, or any day, male or female. That is intentional, you know what you're doing. That's what strollers are for.

The child that shot him self mentioned above, who was in the apartment when it happened? It's been awhile since I've heard anything about this story. I thought the mother was home.

The mother and father were both home.   The articles posted said they were making dinner.  Why not charge them both?  Just because it was registered to the father?
