I was sitting in the "peanut gallery" for most of the Charter Review meeting Monday night.
Landon, and some of the others, said that there are a lot of months that there is "not enough business to fill the agenda most months"!!! I guess this means that we should expect the next Section 8 contract to take SIX years instead of just THREE.
If there is "not enough" for two meetings a month" why do they insist on having several MORE meetings...ooops, I mean "pre-arranged discussions of public business by a majority of our legislative authority"... every month??? If they would cut those out, they would need at least FOUR meetings every month!!!
WHY??? Because they canNOT understand that they are the "LEGISLATIVE authority" and that the City Manager "manages the city" (hence the title)!!!
They canNOT understand the plain, simple English in the City Charter:
SECTION 8. ADMINISTRATION.
City Council shall adopt by ordinance an administrative code which shall set forth the organizational structure and assignment of responsibilities of the various departments and divisions in the City service. The organization thus established shall be administered by the City Manager.
Once they adopt that "administrative code", which they have, they have NO OTHER administrative duties except to revise that code, if necessary.
Nor does our council (or the law deparment, for that matter) understand the plain, simple English in the Ohio Revised Code:
731.05 Powers of legislative authority.
The powers of the legislative authority of a city shall be legislative only, it shall perform no administrative duties, and it shall neither appoint nor confirm any officer or employee in the city government except those of its own body, unless otherwise provided in Title VII [7] of the Revised Code. All contracts requiring the authority of the legislative authority for their execution shall be entered into and conducted to performance by the board or officers having charge of the matters to which they relate. After the authority to make such contracts has been given and the necessary appropriation made, the legislative authority shall take no further action thereon.
This also makes one wonder how in the world council thinks they can make themselves responsible for the overseeing and admisitration
of the CONSOC contract without violating BOTH the City Charter and the ORC!!!
The language is clear!! Are council and the law department just ignorant, or are they scofflaws...or both???
