The Power Siting Board could be the deal breaker for the AK/SunCoke deal. The city of Monroe Officials have filed a motion to have the Power Sitting Board certify the 50+Megawatt generator at the SunCoke Plant.
 
The Ohio Power Siting Board's mission is to support sound energy policies that provide for the installation of energy capacity and transmission infrastructure for the benefit of the Ohio citizens, promoting the state's economic interests, and protecting the environment and land use.
 
Monroe officials feel that the plant will exceed current environmental impact limits required of new power generating plants in Ohio.
 
In 2 days, representatives from Monroe as well as Mr. Schiavone will be meeting Ohio Power Sitting Board Administrative Law Judge Scott Farkas, to set the ground rules for proceeding with hearings.

4906.01 Power siting definitions.

As used in Chapter 4906. of the Revised Code:

(A) “Person” means an individual, corporation, business trust, association, estate, trust, or partnership or any officer, board, commission, department, division, or bureau of the state or a political subdivision of the state, or any other entity.

(B) “Major utility facility” means:

(1) Electric generating plant and associated facilities designed for, or capable of, operation at a capacity of fifty megawatts or more;

(2) An electric transmission line and associated facilities of a design capacity of one hundred twenty-five kilovolts or more;

(3) A gas or natural gas transmission line and associated facilities designed for, or capable of, transporting gas or natural gas at pressures in excess of one hundred twenty-five pounds per square inch.

“Major utility facility” does not include electric, gas, natural gas distributing lines and gas or natural gas gathering lines and associated facilities as defined by the power siting board, nor gas or natural gas transmission lines over which an agency of the United States has exclusive jurisdiction, nor any solid waste facilities as defined in section 6123.01 of the Revised Code.

(C) “Commence to construct” means any clearing of land, excavation, or other action that would adversely affect the natural environment of the site or route of a major utility facility, but does not include surveying changes needed for temporary use of sites or routes for nonutility purposes, or uses in securing geological data, including necessary borings to ascertain foundation conditions.

(D) “Certificate” means a certificate of environmental compatibility and public need issued by the power siting board under section 4906.10 of the Revised Code or a construction certificate issued by the board under rules adopted under division (E) of section 4906.03 of the Revised Code.

I guess they met yesterday. Only the attorney for Monroe got his words on record. Nothing really happened with Ohio Power Sitting Board Administrative Law Judge Scott Farkas and Attorney Frank Schiavone.
