              Authorize Contract for Demolition Services and the

                              Acquisition of Real Estate

PURPOSE
Authorizing the City Manager to enter into a contract with O’Rourke Wrecking for demolition services for the Central Avenue Demolition Project, the acquisition of real estate at 1325 Central Avenue, and declaring an emergency.

BACKGROUND and FINDINGS
The Central Avenue Demolition Project will acquire real estate and demolish property at 1325, 1329 and 1347 Central Avenue. Bids for the demolition portion of the project were opened on November 3rd. After declining the request of the apparent low bidder that they be allowed to change their bid response, the City negotiated and
agreement with the second lowest bidder, O’Rourke Wrecking.

The City currently owns 1329 and 1347 Central Avenue and will acquire 1325 Central Avenue. 1325 and 1327 Central will be demolished in the first phase of the project. Once funds are available, 1347 Central will be demolished.

ALTERNATIVES
Do not proceed with the Central Avenue Demolition Project.

FINANCIAL IMPACT
The total cost of phase one of the project is $215,000. The demolition contract with O’Rourke Wrecking for phase one will be $115,000 to be paid from NSP Funds and the cost of acquisition of 1325 Central Avenue of $100,000 will be paid from NSP Funds ($85,000) and UDAG Funds ($15,000)

CONFORMITY TO CITY POLICY
This conforms to city policy to convert underutilized commercial and industrial property to productive uses as provided for in the City’s Master Plan.

OTHER CONSIDERATIONS
None

RECOMMENDATION
Staff recommends approval of the contract with O’Rourke Wrecking and the acquisition of 1325 CentralAvenue as an emergency because of the hazardous condition of 1327 Central Avenue and so that demolition can proceed immediately before winter

                                 RESOLUTION NO. R2009-42

A RESOLUTION AUTHORIZING A CONTRACT WITH APOSTLE OF RIVER OF POWER MINISTRIES FOR THE PURCHASE OF CERTAIN REAL PROPERTY LOCATED AT 1325 CENTRAL AVENUE AND DECLARING AN EMERGENCY.

BE IT RESOLVED, by the City Council of the City of Middletown, Butler/Warren
Counties, Ohio that:

Section 1
The City Manager is hereby authorized to enter into a contract for the purchase
of certain real property, located at 1325 Central Avenue with Apostle of River of Power Ministries. The contract shall be in a form satisfactory to the City Manager, and is subject to the approval of the Law Director.

Section 2
For said purposes, the Director of Finance is authorized and directed to expend a
sum not to exceed $100,000.00 of which $85,000.00 shall be from the NSP Fund and $15,000.00 from the UDAG Fund, which said sums are hereby appropriated.

Section 3
This resolution is declared to be an emergency measure necessary for the
immediate preservation of the public health, safety and general welfare, to wit: to allow
the City to purchase the property and demolish it before winter, and shall take effect
and be in force from and after its adoption.
