Here is some of the legislation for tomorrow's meeting;
LEGISLATION
1. Resolution No. R2010-03, a resolution endorsing the substitute school tax levy issue for the Middletown City School District. (2nd Reading) 2. Ordinance No. O2010-18, an ordinance establishing a procedure for and authorizing a ontract with Miami Valley Regional Crime Lab for crime lab services for the Division of Police or the 2010 year. (2nd Reading) 3. Ordinance No. O2010-19, an ordinance establishing a procedure for and authorizing contracts with Western & Company and M&M Lawncare for grounds maintenance for the three year period from 2010 through 2012. Will these be given the rubber stamp approval treatment? Probably. Will anyone of the Councilmembers question how many bids were received for the lawn services and Crime Lab services or will it be handled that they are the "only game in town" as to choices? How far do we extend the bid area in cases such as this and are we thorough enough in our search for suppliers? Are any of the councilpeople really questioning whether the city is getting the most bang for the buck in all monetary transactions with city suppliers? We're a cash strapped city, remember? Really don't know, do we?

There's also something about Adkins proposing EMERGENCY legislation (I thought they were going to cut down on this emergency stuff) on $685,000 of CDBG money for approval where $221,000 goes for code enforcement and only $200,000 goes to streets.(streets shortchanged again) That's only $421,000 of the $685,000. Where does the remaining $264,000 go? Story doesn't say.
On the former Taft Elementary land for a clinic (also an emergency vote).....Landen says that the city can take back the land if something isn't built on it "in a reasonable amount of time". What constitutes a "reasonable amount of time", Leslie? They can also take back the property if the building ceases to be a clinic in the future. What would the city do with yet another empty building if that happened? Are we thinking this through properly Council, or are we rushing (emergency legislation) through another potential cluster on your part? ![]() |

Question 1: What are the City's plans for the CDBG-funded office facility at 9th & Yankee that BCCH currently occupies?
Question 2: What are the City's plans for the CDBG-funded former Senior Citizen Center that adjoins the Municipal Building?

? 1: Probably a companion facility offering different but related activities. As with the new Taft site, I believe there are conditions on how this property can be used. Would be nice to see this building turned ovber to the local health dept., though there might be restrictions preventing this.
? 2: Possibly a sale to MU-M for their next area facility?
Or is that concept for the adjacent Womens' Center?

As noted before, again this year more than 50% of the $685,000 in FY 2010 CDBG funds will be spent on Program Administration and Program Delivery (Housing Code Enforcement and Housing Rehabilitation salaries & fringe benefits).
With $130,000+ for Program Administration, $221,000 for Housing Code Enforcement (mostly Program Delivery) and $17,000 for Housing Rehabilitation Program Delivery, you'll see that $368,000+ is spent for staffing!
And they call this "bang for the HUD buck?"

Can anyone explain why the following Resolution (R2010-05) is necessary tonight??? Exactly what does it do??? Do all council members understand this??? If not, will they vote for it anyway???

It appears they are taking money out of an unappriated fund for transit and then putting it back into the unappropriated fund associated with transit. Maybe they have to not have money sitting too long unappropriated, something like a rainy day fund, and move it out on paper, while putting it back in? This must be done under an emergency legislative action right? Does Middletown transport its citizens to Warrent Cty? Where would one find all those account bumbers which correspond with the general fund?

But it says "from the Transit Fund of the City [#530] to accounts of the City [account 530]" !!
How can one "transfer" money out of and into the same account???
Go to the bank and try to deposit a check into the same account from which it is drawn!!!

So…as explained during tonight‘s council meeting: $500,000+ gets transferred FROM the General Fund INTO the Auto & Gas Tax Fund, to cover the costs of mowing parks and other areas outside of road or street right-of-ways (ROWs). This is done to save the cash-strapped General Fund some money. Then $345,000 is paid OUT OF the Auto & Gas Tax Fund to mow ALL of the grass. Can anyone explain to me: 1. How this saves the General Fund money??? 2. Why there is not an EXTRA $500,000 in the Auto & Gas Tax Fund for street paving (or for alley paving in historic districts)??? Anyone??? |

I understood from one poser the Auto and Gas Tax Fund was to be used for street repair.
I can only offer the following comment: For a year I've said the city ordinance that allowed monies to be altered 21 years ago from street repair needed to be moved back into its previously dedicated status. Not one counccil person in that time, nor present, as ever mentioned such a commonsense and rudimentary action. I really don't know what the new council members are doing. To your point Mike, it would seem if the ordinance was put back in place, and the Auto and Gas Tax Fund used, if I understand it to have been stated, that;s a start to reversing 20 years of damage. Evidently, this approach must be much too complicated, as no one has acted upon it. Maybe a ? for ASJ at her meeting.

Acclaro It's time to stand up & clean up these accounts in the City.
Auto & Gas Tax - should be used for street repair only. Water & Sewer Fund - To seperate the water and sewer lines. We can not let the City continue this money shell game. |

Acclaro, the Auto & Gas Fund was NOT part of the 1987 change that allowed the INCOME TAX STREET FUND to be used elsewhere. The Auto & Gas Fund comes back to Middletown from the state from the license plate fees and gasoline taxes. The state requires that this money be used for three street related items. This fund is between $3 and $4 million dollars per year.
1. Electronic (traffic signals-streets only) but this money has been used for signal at the airport and many other uses. If you remember a few years ago several signals were removed because there was no money for repairs.
2. Street repair (where has this money gone the last 25 years)
3. Grounds (this is for the shoulders of roads and medians only.) This money is used to mow the airport and all the parks and all other city owned property. The rest of this money just disappears.
As you can see, misappropriation of these funds is and has been the normal from our city building for twenty + years.

Also my understanding is that money may be added to this fund, but it still can only be used for the intended purpose. This fund can not be used as a slush fund and spent for things other than the way the state requires.

Nick- and just who would one report this alleged misappropriation of funds by the city for the last 20+ years to? Why do you think it hasn't been reported long before now and do any of you think it would be worth the time and effort to report this? Would the agency, I assume in Columbus, be interested in hearing any of this or not? OR, is this done all the time by towns across Ohio and it ain't no big deal even though it's a violation of the law?

Ohio has the 4tf highest fuel tax in the country (another reason to leave this state behind). It does appear that the funds are to be used for bridges, streets, and infrastructure. My question would be Nick, where and what evidence do you have of this violation?
